1. Rental Agreement
By completing a booking on hire.byronfilm.com, you (“the Hirer”) enter into a binding rental agreement with Byron Film Pty Ltd (“Byron Film”). A digital rental agreement will be sent to your email for e-signature via eSignatures.io. Hire commences only after both payment and signed agreement are received.
2. Pricing & Payment
- All listed prices are in Australian Dollars (AUD) and are exclusive of GST.
- 10% GST is added at checkout and reflected in the final total.
- Daily rates apply to each calendar day of hire, inclusive of both pickup and return days.
- Payment is processed via Stripe. Byron Film does not store card details.
- No bond or deposit is required. A digital rental agreement is used in lieu.
3. Hire Period & Return
- Equipment must be returned by close of business on the agreed end date.
- Late returns will be charged at the standard daily rate per day or part thereof.
- Extensions must be requested and approved in writing before the scheduled return date.
4. Damage, Loss & Liability
- The Hirer is fully responsible for all hired equipment from time of pickup/delivery until return.
- Any damage (including accidental damage) will be assessed and charged at full repair or replacement cost.
- Byron Film recommends Hirers obtain appropriate production insurance before hire commences.
- Loss or theft must be reported to Byron Film and the relevant authorities immediately.
- Byron Film's liability is limited to the value of the hired equipment and excludes consequential losses.
5. Pickup & Delivery
- Pickup: Free from our Byron Bay studio. Address provided upon booking confirmation.
- Delivery: Available within the Byron Bay region. Flat fee of $50 for local deliveries; higher rates may apply for regional delivery.
- Delivery zones and surcharges are confirmed at time of booking.
- The Hirer must be available to receive delivery at the nominated address and time.
6. Cancellations & Refunds
- Cancellations made 48+ hours before hire start: Full refund, less Stripe processing fee.
- Cancellations made 24–48 hours before hire start: 50% refund.
- Cancellations made less than 24 hours before hire start: No refund.
- Byron Film reserves the right to cancel bookings due to equipment unavailability. A full refund will be issued in such cases.
7. Equipment Care
- All equipment must be used in accordance with manufacturer guidelines.
- Equipment must not be modified, disassembled, or used for illegal purposes.
- Equipment should be stored securely and protected from weather and physical damage.
- Byron Film reserves the right to refuse hire to any party deemed at risk of misuse.
8. Availability
Equipment availability is checked server-side at time of checkout. Byron Film makes every effort to honour bookings, but availability may change due to maintenance, damage, or prior bookings. Byron Film will contact the Hirer as soon as possible if equipment becomes unavailable after a booking is confirmed.
9. Privacy
Byron Film collects personal information (name, email, phone, address) solely for the purpose of processing and managing equipment hire. This information is not sold or shared with third parties, except as required by payment processors (Stripe) and contract platforms (eSignatures.io).
10. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
